The regulation method for the guarantee of political fairness in broadcasting varies from one nation to another. French regulation of political fairness is the representative example of the quantitative method based on politician’s speaking time on TV programs. This research attempts to present the nature and social meaning of the political fairness regulation in french broadcasting by tracing its origin and evolution and by examining the concrete regulation method.
The regulation’s approach employs the concept of pluralism to well serve the liberty of expression. The highest courts in France supported consistently the value of media pluralism as the essential element of democracy. As the first form of pluralism regulation was introduced to ensure the independence of the state-run broadcasting, its objective was to avoid absence of the opposition party’s exposure on TV. The first rule was established from a perspective of parliament, but it has evolved to consider the equity of diverse political parties’ visibility by reflecting the actual voters’ will. Politician’s speaking time is thoroughly measured in seconds, but the equilibrium is evaluated with flexibility, considering the programming conditions. In the event of a violation, the concerned broadcaster is supervised by the regulatory body until the rule is respected as the purpose of the sanction meant to improve the political pluralism in the broadcasting landscape.
